Execution file 506468-12-24: stage B attorney fee cancelled in 2025 and awarded again at Mizrahi Tefahot Leasing's request (2026)

On 21.10.2025 the execution registrar found that the debtor was outside Israel on the reported date of service, corrected the date of service of the warning and cancelled all proceedings and the stage B attorney fee. On 9.9.2026 the same registrar granted, "as requested", Mizrahi Tefahot Leasing's request to award the stage B fee again.

What this page is based on

This page is based on three documents from execution file 506468-12-24 at the Netanya Execution Office: the decision of Registrar Moti Buchbot of 21.10.2025, the creditor's request of 31.8.2026 to award a stage B attorney fee, and the same registrar's decision of 9.9.2026. The decisions are not published on the Enforcement and Collection Authority's website; copies with the debtor's details blacked out are kept in the site's source archive. The figures on the increase of the debt come from the execution file records. This is a single debtor's proceeding, described here as a neutral item without identifying details.

Background: attorney fees in a promissory-note file

The creditor in the file is Mizrahi Tefahot Leasing Ltd, and the file was opened to enforce promissory notes. Under section 10(a) of the Execution Law, 5727-1967, the creditor's attorney fee is awarded according to the Israel Bar's minimum tariff, unless the registrar, upon request, set a different fee. Under section 10(c), the fee is treated as expenses under section 9 and bears linkage differentials and interest from dates set in the regulations. According to the creditor's request, a "stage B" fee is awarded once actual collection steps have been taken after the period set in the Execution Regulations (fees, attorney fees and expenses) has passed.

The decision of 21.10.2025: date of service corrected, proceedings cancelled

The debtor attached an entries-and-exits report to a request for an extension of time, and the creditor was required to respond to it. In the decision of 21.10.2025 the registrar found that, according to the report, on the date of service of the warning reported by the creditor (22.12.2024) the debtor was outside Israel's borders.

The registrar ordered the date of service of the warning corrected to 29.9.2025, the date the opposition and the request for an extension were filed, and ordered "the cancellation of all proceedings carried out in the file, and the cancellation of the stage B fee added to the debt in the file". He added that the parties' arguments on the substance of the debt are for the court hearing the opposition, transferred the opposition to the Netanya Magistrates' Court, and held that "the stay of proceedings and of funds in the file shall remain in place". According to the execution file records, the amount then cancelled as the stage B fee was NIS 21,456.50.

The creditor's request of 31.8.2026

According to the request, on 31.5.2026 the Netanya Magistrates' Court gave a decision dismissing the debtor's opposition in full, and on 2.6.2026 the registrar ordered the stay lifted and the principal of the debt increased by NIS 2,000 in legal costs. The creditor argued that, once the statutory period from the updated date of service had passed without the debt being paid, it took actual collection steps, including attachments and a vehicle attachment, so the conditions for awarding the stage B fee "a second time" were met under section 10(a) of the Law and the Israel Bar Rules (Recommended Minimum Tariff), 5760-2000.

The creditor argued that the 2025 cancellation "stemmed solely from the extension of time given to the debtor and the update of the date of service, and not from any reason on the merits". The request states that the date of service was updated to 29/9/26; in the decision of 21.10.2025 itself the date is 29.9.2025.

The decision of 9.9.2026 and the increase of the debt

The decision was given as a note on a general request, and reads in full: "As requested, in accordance with the provisions of the Execution Law." It contains no further reasoning, does not state the amount of the fee and does not say whether a fee different from the tariff was set. The sources do not state whether the request was sent to the debtor for a response before the decision was given.

According to the execution file records, on 10.9.2026 the debt was increased by NIS 21,456.50 under the entry "principal of attorney fee - decision", with a value date of 5.6.2026. This is the same amount that was cancelled in 2025, and the value date precedes both the decision and the request. The sources do not explain the reason for this value date.

Link to the vehicle pledge file

In a separate file of the same creditor at the Haifa office, vehicle pledge file 515509-06-24, Registrar Shirley Gideon noted in a decision of 16.8.2026 that the ledger filed by the creditor "included a stage B fee component, even though this component was apparently cancelled in the other proceeding", and ordered the creditor to explain why it remained. See file 515509-06-24: vehicle sale approved and buyer's details corrected.

What this means for debtors

As the registrar noted, cancelling proceedings because of a defect in the service of the warning does not decide the substance of the debt; that is for the court hearing the opposition. A debtor who sees a new attorney-fee entry in a file can check the decision it rests on, the amount and the value date. The decisions in this file are not binding precedent. The proceedings are ongoing, and the sources do not state whether a request or appeal against the decision of 9.9.2026 was filed. According to the request of 31.8.2026, the opposition was dismissed on 31.5.2026, after which actual collection steps were taken, including attachments and a vehicle attachment.
